1. Who we are and who these terms apply to
These terms govern the use of the espectrosolucoes.com.br website and of the Espectro (sales tracking) and Espectro Pay (PIX checkout) services, offered by Espectro Soluções, the trade name of 62.060.485 JOAO FLAVIO DE SOUZA, CNPJ 62.060.485/0001-66, São Sebastião do Paraíso/MG, Brazil. Whoever contracts and uses the services is referred to here as the customer.
By using the services, the customer agrees to these terms and to the privacy policy.
Contact: privacidade@espectrosolucoes.com.br or the contact form.
2. The service
- Espectro receives the sales from the checkouts the customer connects, matches them with the UTMs and with the data from the ad accounts the customer authorizes, shows the figures in a dashboard and sends the purchases to the customer's pixel on Meta.
- Espectro Pay provides PIX checkout pages for the products the customer registers, sends the purchase emails and notifies the customer's systems by webhook. Payment is processed by a partner payment processor.
- For customer service and content, with the Meta accounts they connect, the customer can reply to and moderate comments, reply to Messenger and Instagram messages, view ad leads, publish and schedule posts and keep the product catalog. None of this happens without the customer's action or a rule they turned on.
- The dashboard figures depend on the information sent by the checkouts, by the ad platforms and by the customer. There may be differences from the figures reported by each platform.
- We may change, improve or remove features. Changes that affect the contracted use will be announced in advance.
3. Access
The customer is responsible for keeping the dashboard password, the webhook tokens and the keys they register secret, and for everything done with them. If they suspect misuse, they must notify us immediately.
4. Customer responsibilities
- Ads: the content, budget, targeting and results of the ads are the customer's responsibility, and the customer must follow the policies of Meta and of any other platforms they use.
- Buyer data: the customer is the controller of their buyers' data and must have a legal basis to process it, disclose this in their own privacy policy and respond to data subjects' requests.
- Products and sales: the customer is responsible for the products they sell, for delivery, exchanges, refunds and taxes, and for customer service to buyers.
- Pausing or changing campaigns: when the customer pauses or reactivates a campaign through the dashboard, the decision is theirs.
- Content and customer service: the customer is responsible for what they publish, for the replies and messages they send through the dashboard and for the automatic rules they turn on, and must follow Meta's policies (including messaging windows and rules). To notify buyers by WhatsApp or Messenger, the customer must have their permission when the law or the platform requires it.
- Lawful use: the service may not be used to sell prohibited products, deceive consumers, send unsolicited bulk messages or violate the rights of others.
5. Suspension for abuse
We may suspend or terminate access, with notice whenever possible, in the event of use contrary to these terms or to the law, attempts to break into or overload the systems, fraud, or a request from a competent authority. If there is an immediate risk to other people or to the systems, suspension may take place before notice is given.
6. No guarantee of results
Espectro shows information and Espectro Pay processes orders. Neither guarantees an increase in sales, profit, return on ad spend or any other business result. Decisions made based on the dashboard figures are the customer's.
7. Limitation of liability
We work to keep the services online and the data accurate, but we are not liable for failures of third-party services (such as ad platforms, other companies' checkouts, the payment processor, and internet and server providers), nor for indirect losses or lost profits, to the extent permitted by law.
8. Data and end of use
The data the customer brings to the service remains theirs. When the customer removes a connection or stops using the service, the data is deleted as described on the data deletion page.
9. Changes to these terms
These terms may change. The date at the top will be updated and important changes will be communicated to customers before they take effect.
10. Governing law and jurisdiction
These terms are governed by the laws of Brazil. The courts of the district (comarca) of São Sebastião do Paraíso/MG are chosen to resolve any matter relating to them, except where the law guarantees a different venue.
